Terms of Service
Please read these terms carefully before using our service.

1. Acceptance of Terms
By creating an account, accessing, or using the QueueLeads platform, website, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Description of Service
QueueLeads provides an AI-powered sales engagement platform that allows users to upload contact lists and automate outbound voice calling, SMS/text messaging, lead qualification, and appointment setting.
3. Account Registration
To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Compliance with Laws (TCPA & DNC)
This is the most critical section. Please read carefully.
You acknowledge and agree that you are the sole initiator of any calls or messages (including SMS/text messages) sent through the Service. QueueLeads acts solely as the technology provider.
You represent and warrant that:
- Consent: You have obtained all necessary prior express written consents from the recipients of your calls and SMS/text messages, as required by the Telephone Consumer Protection Act (TCPA), the Cellular Telecommunications Industry Association (CTIA) guidelines, and other applicable laws.
- Do Not Call (DNC) Lists: You will not use the Service to call or message numbers listed on the National Do Not Call Registry, state DNC lists, or your internal company DNC list, unless an exemption applies.
- Recording Laws: You are aware of the laws regarding call recording in your jurisdiction (and the jurisdiction of your called parties). Some states require "Two-Party Consent." You agree to configure the Service to play necessary recording disclosures if required by law.
- Caller ID: You will not use the Service to transmit misleading, inaccurate, or falsified Caller ID information ("Spoofing").
QueueLeads reserves the right to immediately terminate the account of any user suspected of illegal telemarketing practices, spamming, or violating the TCPA.
5. SMS/Text Messaging Terms
The Service includes the ability to send SMS/text messages on your behalf. The following terms apply specifically to SMS messaging:
- SMS Consent: You represent and warrant that you have obtained all necessary prior express consent from recipients before sending SMS messages through the Service, as required by the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and all other applicable laws and regulations.
- Opt-Out Compliance: All campaign SMS messages sent through the Service include opt-out instructions (e.g., "Reply STOP to opt out"). You must honor all opt-out requests immediately and maintain accurate opt-out records.
- Transactional Messages: Appointment confirmation messages are sent automatically when a caller books an appointment through your AI receptionist. These are transactional in nature, as the recipient initiates the interaction by calling your business and verbally agreeing to book the appointment during the recorded phone call.
- Message Content: You are solely responsible for the content of SMS messages sent through the Service. Messages must not contain prohibited content including but not limited to: illegal substances, age-restricted content, hate speech, or deceptive marketing claims.
- Message Frequency: You agree to send messages at reasonable frequencies and not to use the Service to send excessive or repetitive messages that could constitute spam.
- Message and Data Rates: Message and data rates may apply to recipients. You agree to inform recipients that standard messaging and data rates from their carrier may apply.
- Help and Support: Recipients may reply HELP to any message for assistance, or contact us at contact@queueleads.ai.
QueueLeads reserves the right to suspend SMS capabilities for any account that violates these terms or receives excessive opt-out requests or carrier complaints.
6. Acceptable Use Policy
You agree not to use the Service to:
- Engage in fraud, scams, or deceptive practices.
- Transmit unsolicited advertisements, "robocalls," or spam text messages without proper consent.
- Harass, threaten, or defraud any person.
- Upload data containing Protected Health Information (PHI) subject to HIPAA, unless you have signed a Business Associate Agreement (BAA) with us.
- Reverse engineer, decompile, or attempt to extract the source code of the Service.
7. Fees and Payment
- Subscription: The Service is billed on a subscription basis (e.g., Monthly or Annually). You agree to pay all fees associated with your chosen plan.
- Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.
- Usage Costs: Certain plans may include "per minute" or "per lead" costs. You agree to pay any overage fees incurred.
- Refunds: We offer a 7-day money-back guarantee. Beyond that, payments are non-refundable.
8. Intellectual Property
- Our IP: QueueLeads, its code, logo, and AI models are the exclusive property of QueueLeads.
- Your Data: You retain ownership of the contact lists ("Client Data") you upload. You grant us a license to process this data solely to provide the Service to you.
9. AI Limitations
You acknowledge that the Service utilizes Artificial Intelligence. AI systems may occasionally produce incorrect, inaccurate, or unexpected results ("Hallucinations"). QueueLeads does not guarantee that the AI agents will perfectly understand every conversation or that the information provided by the AI during a call is 100% accurate. You are responsible for verifying the results of the AI outreach.
10. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
11. Limitation of Liability
To the maximum extent permitted by law, QueueLeads shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Specifically, QueueLeads is not liable for any fines, penalties, or lawsuits arising from your violation of the TCPA, TSR, or other telemarketing laws.
In no event shall our aggregate liability exceed the amount you paid us in the last twelve (12) months.
12. Indemnification
You agree to defend, indemnify, and hold harmless QueueLeads and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from:
- Your use and access of the Service.
- Any claim that your calls or messages (including SMS/text messages) violated the TCPA, DNC regulations, or privacy rights of a third party.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
